GAO Gives HUBZone Program Priority over Service Disabled Veteran Owned Firms
Federal Government Full and open competition contracts must be awarded with a price
evaluation preference. The offer by a HUBZone vendor will be
considered lower than the offer of a non-HUBZone or non-small business
provided that the offer by the HUBZone small business is not more than
10% higher.
Example 1:
In a full and open competition, a qualified
HUBZone vendor submits an offer of $100, a non-HUBZone small business
submits and offer of $97, and a large business submits an offer of $95.
It appears the lowest offeror would be the large business at $95.00
however because a qualified HUBZone vendor offer was submitted the contracting officer must apply the price evaluation preferences. As such, the HUBZone offer of $100 is not more than 10% higher than the $95 offer of the large business.
Example 2:
In a full and open competition, a qualified HUBZone firm
submits an offer of $103, a non-HUBZone small business submits and offer
of $100, and a large business submits an offer of $93. The lowest,
responsive, responsible offeror would be the large business.
Again, in this case, because a qualified HUBZone firm is
involved in a fully competitive acquisition, the contracting officer
must apply the price evaluation preference. As such, the HUBZone firm
offer of $103 is more than 10% higher than the $93 offer from the large
business. Therefore, the qualified HUBZone firm does not displace the
large business as the lowest, responsive, and responsible offeror. In
addition, the non-HUBZone small firm with its offer of $100, does not
displace the large business because a price evaluation preference cannot
be applied to benefit a non-HUBZone small business.
Calculation: $103 Hubzone - $93 other offer =$10.00 Difference / $93 = 10.75%
If the HUBZone vendor had quoted $92 the HUBzone vendor would
have only been 9.677% higher and awarded to the HUBZone vendor as the
contracting officer must apply the price preference.
Additional Preference Notes for Prime Government Contractors and companies seeking federal government awards:
Company "A" bids on a government contract. If Company "A" demonstrates higher HUBZone
utilization, then Company "A" may then receive up to a (10%) price
preference compared to their other bids because of their utilization of a
HUBZone business entity.
As a federal contractor of $650,000 or more you are
required to spend the following allocations of contract spend -23% Small Business, 3% WBE, 3$ HUBZone 3% SDB, 3% SDVOB. Points are
cumulative so purchasing from National Supply Network, LLC, would afford your organization a cumulative 29% total diversity business dollar spend. The cumulative value adds customer
business solutions for your organization when seeking additional federal government contracts.
